Important Notice

PLEASE READ THESE TERMS CAREFULLY. By placing an order through a restaurant website powered by EatsForAI, you agree to these Terms of Service. These terms include important limitations on our liability and require disputes to be resolved through binding arbitration.

EatsForAI is a technology platform, not a restaurant. We provide online ordering technology to restaurants. The restaurant you order from is solely responsible for preparing your food and fulfilling your order.

1. Acceptance of Terms

By accessing or using any restaurant ordering website powered by EatsForAI ("Service"), you agree to be bound by these Customer Terms of Service ("Terms"). If you do not agree to these Terms, do not place an order.

EatsForAI, operated by EATS GROUP ("we," "our," or "us"), provides technology that enables restaurants and food trucks to offer online ordering. When you place an order, you are entering into a transaction with the restaurant, not with EatsForAI.

2. Our Role as a Technology Provider

EatsForAI is not a restaurant, food preparer, or food delivery service. We provide software that helps restaurants accept and process online orders.

We do not:

  • Prepare, cook, or handle any food
  • Employ or control restaurant staff
  • Operate any restaurant or food establishment
  • Deliver food (delivery is provided by restaurants or third-party services)
  • Set menu prices, portions, or ingredients
  • Verify restaurant health, safety, or licensing compliance

The restaurants available through our platform are independent businesses. Each restaurant is solely responsible for its food, service, and compliance with applicable laws.

3. Restaurant Responsibility

The restaurant you order from is solely responsible for:

  • Food quality and safety: Preparation, handling, cooking, and food safety compliance
  • Order accuracy: Ensuring your order is prepared correctly and completely
  • Menu accuracy: Maintaining accurate descriptions, prices, and availability
  • Ingredient information: Providing accurate ingredient and allergen information
  • Portion sizes: Determining and providing appropriate portions
  • Health and licensing: Maintaining required permits, licenses, and health certifications
  • Customer service: Resolving issues with your order

Any issues with your order, food quality, or service should be directed to the restaurant.

4. Allergen and Dietary Information Disclaimer

IMPORTANT: IF YOU HAVE FOOD ALLERGIES, INTOLERANCES, OR DIETARY RESTRICTIONS, YOU MUST CONTACT THE RESTAURANT DIRECTLY BEFORE ORDERING.

Menu information, including allergen and dietary information, is provided by restaurants. We do not independently verify this information. We make no representations or warranties regarding the accuracy, completeness, or reliability of any allergen, nutritional, or dietary information displayed.

You acknowledge and agree that:

  • Allergen and ingredient information may be inaccurate, incomplete, or outdated
  • Cross-contamination may occur in restaurant kitchens
  • Ingredients and recipes may change without notice
  • You are solely responsible for verifying that menu items are safe for you to consume
  • Reliance on any information provided through the Service is at your own risk

WE STRONGLY RECOMMEND THAT INDIVIDUALS WITH FOOD ALLERGIES OR SENSITIVITIES CALL THE RESTAURANT DIRECTLY TO CONFIRM INGREDIENTS AND PREPARATION METHODS BEFORE PLACING AN ORDER.

5. Menu and Pricing

Menu items, descriptions, photos, and prices are provided by restaurants and may not always be accurate or current. We do not guarantee:

  • Item availability at the time of your order
  • Accuracy of menu descriptions or photos
  • That prices displayed match in-store prices
  • That photos accurately represent the food you will receive

Restaurants may modify menu items, prices, or availability at any time. If a significant issue arises with your order due to menu inaccuracies, please contact the restaurant directly.

6. Delivery Services

When delivery is available, it may be provided by:

  • The restaurant's own delivery staff
  • Third-party delivery services (such as Uber, DoorDash, or others)

EatsForAI does not provide delivery services. We are not responsible for:

  • Delivery delays or failures
  • Food temperature or condition upon delivery
  • Actions or conduct of delivery personnel
  • Lost, stolen, or damaged orders during delivery
  • Incorrect delivery addresses provided by you

Delivery-related issues should be directed to the restaurant or the third-party delivery service.

7. Payment and Refunds

Payments are processed by third-party payment processors (Stripe, Square, or Clover). By placing an order, you authorize the charge to your payment method.

Refund requests must be directed to the restaurant. Restaurants set their own refund policies. We facilitate payment processing but do not control refund decisions.

You are responsible for ensuring you have sufficient funds and that your payment information is accurate. Failed payments may result in order cancellation.

8. Rewards Program

Some restaurants offer loyalty rewards programs. If you participate:

  • Points have no cash value and cannot be redeemed for cash, transferred, or sold
  • Points are promotional credits only
  • Restaurants may modify, suspend, or terminate their rewards program at any time
  • Points may expire after periods of inactivity
  • Points may be voided if obtained through fraud or error
  • Restaurants are solely responsible for honoring rewards

We are not liable for any loss of points or rewards due to program changes, account issues, or restaurant decisions.

9. Your Responsibilities

You agree to:

  • Provide accurate contact and delivery information
  • Be available to receive your order at the designated time
  • Verify that menu items are suitable for your dietary needs
  • Contact the restaurant directly for allergen or ingredient questions
  • Not use the Service for any unlawful purpose
  • Not attempt to defraud restaurants or abuse promotions

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES REGARDING THE QUALITY, SAFETY, OR LEGALITY OF ANY FOOD
  • WARRANTIES REGARDING THE ACCURACY OF MENU INFORMATION, ALLERGEN DATA, OR NUTRITIONAL INFORMATION
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE

WE DO NOT WARRANT OR GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF ANY RESTAURANT, FOOD ITEM, OR DELIVERY SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EATSFORAI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • ANY ILLNESS, INJURY, OR DEATH RESULTING FROM FOOD PREPARED BY RESTAURANTS
  • ALLERGIC REACTIONS OR ADVERSE EFFECTS FROM CONSUMING FOOD ORDERED THROUGH THE SERVICE
  • FOOD QUALITY, SAFETY, OR PREPARATION ISSUES
  • ORDER ERRORS, DELAYS, OR FAILURES BY RESTAURANTS OR DELIVERY SERVICES
  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to defend, indemnify, and hold harmless EatsForAI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any dispute between you and a restaurant

13. Dispute Resolution and Arbitration

Informal Resolution

Before filing any formal dispute against EatsForAI, you agree to first contact us through our Contact page to attempt to resolve the dispute informally. Most concerns can be resolved this way.

Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and EatsForAI agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (except disputes with restaurants, which are between you and the restaurant) will be resolved through binding individual arbitration rather than in court.

Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in Los Angeles County, California, or at another mutually agreed location.

Class Action Waiver

YOU AND EATSFORAI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

Exceptions

The following disputes are not subject to arbitration: (a) small claims court cases, (b) disputes seeking injunctive relief for intellectual property infringement.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law provisions.

15. Changes to Terms

We may modify these Terms at any time. Changes will be effective upon posting. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. If the class action waiver is found unenforceable, the entire arbitration agreement will be void.
